Order: This Court previously dismissed Plaintiff's complaint for lack of jurisdiction and failure to comply with Rule 8. ECF5 . This Court granted Plaintiff leave to file an amended complaint by August 6, 2024. ECF5 Plaintiff did not meet this deadline, so this Court issued an order to show cause by September 6, 2024, why this action should not be dismissed with prejudice for failure to prosecute. ECF 8 . Plaintiff also did not meet this deadline, and this Court dismissed the complaint with prejudice on September 9, 2024. ECF 9 . That day, after issuing the dismissal, this Court received Plaintiff's Amended Complaint. ECF10 . This Court will construe this filing as a motion to reconsider the dismissal of his complaint. Although this Court construes pro se pleadings liberally and gives Plaintiff the benefit of the doubt, Bernhardt v. L.A. County , 339 F.3d 920, 925 (9th Cir. 2003), a pro se litigant's pleadings "must meet some minimum threshold in providing a defendant with notice of what it is that it allegedly did wrong." Brazil v. U.S. Dep't of Navy , 66 F.3d 193, 199 (9th Cir. 1995). Plaintiff's filing does not cure the deficiencies identified by this Court in his initial complaint because it does not meet the requirements of Rule 8. See Fed. R. Civ. P. 8(a)(2) (a pleading must contain "a short and plain statement of the claim showing that the pleader is entitled to relief"); McHenry v. Renne , 84 F.3d 1172, 1178 (9th Cir. 1996) (a complaint does not comply with Rule 8 if "one cannot determine from the complaint who is being sued, for what relief, and on what theory"). Plaintiff's filing does not identify a basis for this Court's jurisdiction and does not identify the relief he seeks. Having reviewed and considered Plaintiff's filing, this motion to reconsider the dismissal is DENIED. Ordered by Judge Karin J. Immergut on September 12, 2024.
