MINUTES OF PROCEEDINGS - Case Management Conference held on 9/27/2024 before Magistrate Judge Craig S. Denney. Crtrm Administrator: AB ; Pla Counsel: Keenen Agee ; Def Counsel: Alice Herbolsheimer for the City Defendants & Trenton Ross for the County Defendants ; Court Reporter: Liberty ; Time of Hearing: 9:00 a.m. ; Recording start and end times: 8:53:03 a.m. - 9:35:58 a.m. ; Courtroom: 2 . The Court addresses the parties regarding the purpose of today's hearing. The Court has reviewed the Defendants' Case Management Report (ECF No. 37 ), Plaintiff's Objection (ECF No. 39 ), Plaintiff's Case Management Report (ECF No. 40 , and Defendant's Response (ECF No. 41 ). The Court notes that the parties disagree on six witnesses who the defense would like to depose. The Court hears from the parties regarding the six witnesses. The Court will not allow discovery from Mr. Agee's October 12, 2023, arrest as the current complaint does not include that arrest. Ms. Herbolsheimer expresses concerns that Mr. Agee may have a ghost lawyer. Upon inquiry of the Court, Mr. Agee advises that he is not receiving assistance from a ghost lawyer. The Court reminds the parties to adhere to the Civil Standing Order (ECF No. 17 ) regarding discovery disputes. The Court explains the benefits of consenting to the jurisdiction of the Magistrate Judge for the entirety of the case. IT IS ORDERED that the defense will be allowed to depose Emma Deleon, Italia Palmer, Iyanna Palmer, Amber Carmy, Jessica Appling, and Zack Espinosa. IT IS FURTHER ORDERED that Mr. Agee's Motion to Quash Depositions of Key Witnesses and Alleged Victims (ECF No. 42 ) is moot based on today's ruling. IT IS FURTHER ORDERED that the parties shall submit an Amended Discovery Plan and Scheduling Order with the deadlines outlined in the Defendants' Case Management Report (ECF No. 37 ) by Friday, October 4, 2024.
