ORDER Denying Plaintiff's 20 Motion for Recusal and Notice of Recusal. The court first denies Plaintiff's motion for recusal. It has no merit whatsoever. That fact notwithstanding, this court received ex parte communication originating from Attorney Finucane indicating the likelihood that he would appear in this action should the court render an IRO decision favorable to the plaintiff. The court presumes that Attorney Finucane was attempting to aid the court in adhering to recusal instructions which the undersigned has issued to the Clerk's Office, stemming from a civil action in state court wherein the undersigned was among 30 named defendants who were represented by Attorney Finucane. That state court civil case was dismissed in 2023, and Attorney Finucane is neither a lawyer of record nor a named party in the present matter at this time. Nevertheless, counsel indicated that he may so appear. To be clear, the undersigned perceives no actual conflict of interest. However, the court finds that the risk is too great that the appearance of a conflict could be gleaned from such ex parte communications, in that a litigant such as Mr. Stanley (upon learning of Attorney Finucane's notice of the potential that he might appear as counsel in this matter) could assert that any dispositive ruling by the undersigned could have been affected by such knowledge. Furthermore, recusal without the present articulation would have relied on ex parte communications not otherwise disclosed to Mr. Stanley. It is for this very reason that the court takes great pains to prevent any ex parte communications. Having failed in that endeavor, the court hereby recuses itself from this action and kindly asks the Clerk of Court to please assign it to another judge. To be clear, this decision has nothing to do with Plaintiff's20 Motion and does not in any way impact the undersigned's involvement in any other case except those in which this Order is filed. NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis ; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. § 1915, permits him to do so if, among other things, he submits a financial affidavit showing that he is unable to pay, accompanied by a certified copy of his inmate trust account statement for the six month period preceding his complaint. To assist inmates in demonstrating inability to pay, the District of Connecticut has prepared a standard-form in forma pauperis application. In this case, the plaintiff submitted the wrong in forma pauperis application form. He also did not submit a certified copy of his inmate trust account statement. His application is therefore insufficient. The Clerk of the Court is respectfully directed to send the plaintiff a blank copy of the correct application form at his address of record. The plaintiff is directed to fill out the form completely and accurately, and to file it with the Clerk of the Court along with a certified copy of his inmate trust account statement covering at least the period from January 18, 2024, to July 18, 2024.
