Order on Motion for Leave to Appeal In Forma Pauperis

TEXT ORDER. This case has a long history of Complaints, Amended Complaints and appeals, that, despite their length (up to 151 pages) fail to state a claim for relief that the Court can discern. Indeed, it is precisely because of the rambling length of Ms. Zarlengas filings that the Court has been unable to find a plausible claim for relief that would justify federal question jurisdiction. Most recently, the Court denied Ms. Zarlenga In Forma Pauperis (IFP) status in pursuing an appeal of the denial of a motion for reconsideration that appeared to be an attempt to reopen an appeal on which the plaintiff had previously defaulted. See Text Order of 12/11/24. Ms. Zarlenga filed a Notice of Appeal from that determination and, in the instant Motion (ECF No. 54) requests In Forma Pauperis (IFP) while pursuing that appeal in the Circuit Court. First, the appropriate procedural step seems to be the filing of a new Motion for IFP status in the Circuit Court, not an appeal from this Courts denial. Baugh v. Taylor, 117 F.3d 197, 202 (5th Cir. 1997). (challenge to a trial courts certification of frivolousness under 28 U.S.C. 1915(a)(3) should be by a new Motion to Proceed IFP on Appeal in the Circuit Court and not by an appeal of the district courts denial). Accord, Camp v. Putnam, 807 Fed. Appx. 303, 304-05 (5th Cir. 2020); Lay v. Oklahoma Dept. of Corrections, 746 Fed. Appx. 777, (10th Cir. 2018). Even if Ms. Zarlengas procedural move to appeal this Courts denial of IFP status is proper, on December 11, 2024, the Court denied IFP status because it determined that the current appeal was frivolous and not taken in good faith. 28 U.S.C. 1915(a)(3). That conclusion of frivolousness has not changed and bars this Court from granting the instant Motion (ECF No.54 ), which is DENIED. Ms. Zarlenga is reminded of the earlier directive that she is not permitted to make any further filings in this case other than a notice of appeal. See text Order of June 20, 2024.
