The court held a settlement conference for the remaining two defendants: Trent Allen and Terryonn Pugh. The Pugh case settled fully, subject to the ordinary contingency of approval of the governing authorities. The Allen case settled fully as to the monetary component, subject to the ordinary contingency of approval of the governing authorities, and subject to the contingency that the Monell issue about non-monetary relief will be resolved separately, either by a settlement agreement or by other court process. This means that all claims by all plaintiffs have been resolved, and the only remaining issue is non-monetary relief for the Monell police-practices claim (preserved through the contingency in the Allen settlement). The governing authorities (the City and CARMA) will have satisfied the contingencies of approval of the resolutions by next week. Finalizing the written settlement agreements generally takes thirty to forty-five days. All pending motions other than the summary-judgment motion are mooted. Those motions were withdrawn by counsel on April 3, 2025, leaving only the summary-judgment motion. The parties intend to stipulate by Friday, April 4, to resolving the pending summary-judgment motion and will submit a stipulated order. Because of that agreement and the resolution of all claims for all plaintiffs except for the Monell claim that is preserved in the Allen bellwether case, the existing trial date for the Allen bellwether case in September will be limited to a trial or other court process to address non-monetary relief. That date will remain in place, but this spring, the parties will work to settle the Monell claim on the following timeline. The plaintiffs sent a draft proposal. The City has meetings with stakeholders set for April 24 and May 1. By May 1, they will be in a position to turn around a redline draft to the plaintiffs. The parties will meet in person on May 13. Thereafter, through May 27, the parties will meet and confer to address their disputes. The court sets a further in-person settlement conference for June 4, 2025, to address any issues. An updated redlined agreement must be submitted by email to lbsettlement@cand.uscourts.gov two days earlier. The parties must submit a joint update at the same time summarizing any differences (and should keep it short). They may submit separate confidential statements (again short) with any differences. The parties will submit a short updated case-management statement to the trial judge on Friday, April 4. As part of that process, the parties are reminded that all monetary claims settled but the Lacy settlement requires one additional step discussed today. Within one week, the court expects that there can be a Zoom to put it on the record. The court orders an update by COB on Monday, April 7, with the next steps.
