ORDER GRANTING IN PART MOTION FOR ORDER TO EXEMPT CLAIMS FROM MEDIATION: On July 12, 2024, defendant Meta Platforms Inc. (the Defendant) filed the Motion for Order to Exempt Claims from Mediation (the Motion). (ECF No. 23.) The Motion seeks to exempt the claims brought by plaintiff Mr. Luc A. Despins, in his capacity as Chapter 11 trustee (the Trustee) for the bankruptcy estate of Mr. Ho Wan Kwok, against the Defendant from mediation pursuant to paragraph 2(i) of the Order Directing Parties to Mediation, Appointing the Honorable James J. Tancredi as Mediator and Amending Order Approving Procedures Applicable to Avoidance Claim Adversary Proceedings (the Avoidance Action Procedures Order), entered in Mr. Kwoks bankruptcy case and applicable to this adversary proceeding. (See ECF No. 11.) On August 2, 2024, the Trustee filed a response in opposition to the Motion. (ECF No. 27.) On August 9, 2024, the Defendant filed a reply in support of its Motion and requesting the Court exempt it from not just mediation but the entirety of paragraph 2 of the Avoidance Action Procedures Order. (ECF No. 29.) Upon review of the pleadings, it is hereby ORDERED: The Motion (ECF No. 23) is GRANTED IN PART . Pursuant to paragraph 2(i) of the Avoidance Action Procedures Order, the Trustees claims against the Defendant in this adversary proceeding are exempted from Mediation; and it is further ORDERED: Pursuant to paragraphs 2(f) and 2(j)(iii) of the Avoidance Action Procedures Order, the Trustee shall file any response or objection to the Defendants pending motion to dismiss (ECF No. 18) on or before October 15, 2024 and the Defendant shall file any reply on or before November 14, 2024.
