ORDER GRANTING IN PART MOTION TO BE EXEMPTED FROM MEDIATION: On June 20, 2024, defendant Liberty Jet Management Corporation ('Liberty Jet') filed a motion (the 'Motion') seeking to be exempted from mediation and to dismiss the complaint filed by plaintiff Luc A. Despins, in his capacity as Chapter 11 trustee (the 'Trustee') for the bankruptcy estate of Mr. Ho Wan Kwok. (ECF No. 19.) On July 2, 2024, the Court entered an order regarding the Motion requiring the Trustee to respond to the Motion insofar as it sought an exemption from mediation. (ECF No. 20.) On July 15, 2024, the Trustee responded that he did not object to the Motion insofar as it sought an exemption from mediation. (ECF No. 21.) Accordingly, it is hereby ORDERED: The Motion (ECF No. 19) is GRANTED IN PART. Liberty Jet is exempted from mediation. ORDER REGARDING MOTION TO BE EXEMPTED FROM MEDIATION: On June 20, 2024, defendant Liberty Jet Management Corporation ('Liberty Jet') filed a motion (the 'Motion') seeking to be exempted from mediation and to dismiss the complaint filed by plaintiff Luc A. Despins, in his capacity as Chapter 11 trustee (the 'Trustee') for the bankruptcy estate of Mr. Ho Wan Kwok. (ECF No.19 .) The Motion states that, pursuant to the Avoidance Actions Procedures Order (see ECF No.13 ) decretal paragraph 2(f), the Trustee has 60 days or until August 19, 2024 to respond to the Motion. However, pursuant to the Avoidance Action Procedures Order decretal paragraph 2(j)(iii), the Trustee's time to respond to the Motion, insofar as it is a motion to dismiss, is stayed pending mediation.
