ORDER GRANTING MOTION TO EXPEDITE IN PART: On October 11, 2024, Mr. Luc A. Despins, in his capacity as the Chapter 11 trustee (the 'Trustee') for the bankruptcy estate of Mr. Ho Wan Kwok, the plaintiff in this adversary proceeding, filed a motion seeking default judgement (the 'Motion for Default Judgment') against Mr. Qiang Guo, the defendant in this adversary proceeding. (ECF No. 17.) That same date, the Trustee filed a motion to expedite the hearing on the Motion for Default Judgment (the 'Motion to Expedite'), seeking a hearing on or before October 22, 2024. (ECF No. 18.) The Clerk of Court has entered default against Mr. Guo for failure to respond to the complaint. (ECF No. 12.) No attorney has appeared for Mr. Guo and he has not appeared pro se. Accordingly, it is hereby ORDERED: The Motion to Expedite (ECF No. 18) is GRANTED IN PART. A hearing on the Motion for Default Judgment (ECF No. 17) shall be held on November 5, 2024 at 1:00 p.m. in the United States Bankruptcy Court, 915 Lafayette Boulevard, Bridgeport, CT. On or before October 28, 2024, Mr. Guo shall file any response or objection. On or before November 1, 2024, the Trustee shall file any reply; and it is further ORDERED: Pursuant to Fed. R. Civ. P. 5(a)(2) and 55(b)(2), made applicable in this adversary proceeding by, respectively, Fed. R. Bankr. P. 7005 and 7055, the Trustee is not required to serve Mr. Guo with the Motion for Default Judgment or this Order. Nevertheless, should the Trustee serve Mr. Guo with the Motion for Default Judgment and this Order, a certificate of service demonstrating such shall be filed on or before October 21, 2024.
