ELECTRONIC ORDER: The Court denies Plaintiff Wolfspeed, Inc.'s request to expedite briefing on its Motion to Compel Non-Parties STMicroelectronics, N.V. and STMicroelectronics, Inc. (together, "ST") to Comply with Properly Served Subpoena [Dkt. No. 1]. Wolfspeed requests that the Court order ST to file any response brief on or before April 25, 2024 and that Wolfspeed file any reply brief on or before May 1, 2024, explaining that all fact discovery in the underlying action (The Trustees of Purdue Univ. v. Wolfspeed, Inc., No. 1:21-cv-840 (M.D.N.C.)) must be completed by May 3, 2024. But the dispositive motion deadline in the underlying action is May 1, 2024, see The Trustees of Purdue Univ. v. Wolfspeed, Inc., No. 1:21-cv-840, Dkt. No. 172 (M.D.N.C.), and Wolfspeed provides no explanation for why, even if this third-party discovery is compelled, this Court could not order ST to provide the requested discovery after any May 3 deadline. Consistent with this Court's Local Civil Rules, the Court orders that ST must file any response to the motion to compel [Dkt. No. 1] by May 6, 2024, and Wolfspeed must file any reply by May 20, 2024.
