Minute Entry for Initial Conference proceedings held on 10/22/2024 before Magistrate Judge James R. Cho. Appearances by Steven Verveniotis for plaintiff; Jeffrey Alan Berson for defendant Glendon Hall ("Hall"). No appearance by defendant 308 Chauncey LLC ("Chauncey"). Case discussed. This is a declaratory judgment action involving plaintiff's denial of insurance coverage. Hall is the plaintiff in the underlying state court action. The Court entered the following pretrial schedule: parties to exchange automatic disclosures by 11/5/2024; no amendment of the pleadings or joinder of additional parties permitted after 11/21/2024 without good cause; and parties to complete fact discovery by 4/21/2025. The Court will set a deadline for commencing dispositive motion practice after the parties have completed discovery. Further, for the reasons discussed on the record, in the event defendant Chauncey does not appear in this action, plaintiff shall move for default judgment against Chauncey in conjunction with plaintiff's anticipated summary judgment motion. By 1/22/2025 , parties shall file a joint status report and advise the Court whether they would like a referral to the Court-annexed mediation program or a settlement conference. Plaintiff and Hall do not believe settlement discussions would be productive at this time without the participation of Chauncey. (Cisco Recording.) (SGC) |
