TEXT ORDER-- The Court is in receipt of Defendant's letter dated 02/19/25 ECF No.14 , Plaintiff's letter dated 02/19/25 ECF No.15 and Defendant's letter dated 02/28/25 ECF No.18 . The limited discovery contemplated by the Court in the Pretrial Scheduling Order ECF No.10 with respect to identifying the proper Defendant(s) so the complaint could be amended was not intended to limit more fulsome discovery taken by the parties in the ordinary course. That is why the Pretrial Scheduling Order contains a full discovery schedule. Thus, if Plaintiff wishes to propound discovery requests such as those listed in her 02/19/25 letter (ECF No. 15), she has the right to do so and Defendant must respond or object in accordance with court rules. That being said, Defendant appears to have provided documents properly identifying Plaintiff's employer. The ownership, "corporate hierarchy" and corporate officers/directors is not necessary to identify the proper corporate defendant(s) that employed Plaintiff. If Plaintiff is not in a position to file a motion to amend at this time despite having received this information, then the Court will extend the deadline to file a motion to add new parties or amend pleadings, until June 1, 2025, which will allow time for more fulsome discovery. Before seeking Court leave to file a motion to amend a pleading, the party seeking amendment shall provide a draft of the proposed amended pleading to all parties in an effort to obtain consent to the amendment. Any request for leave of the Court to file a motion to amend shall attach, as an exhibit, a red-lined version of the proposed amended pleading delineating how it differs from the previous pleading. See Local Civ. R. 15.1. So Ordered by Magistrate Judge Stacey D. Adams on 3/5/2025. (JB) |
