ORDER: Accordingly, upon due consideration, the Motions [ECF Nos.5 ,6 ] are GRANTED. Pursuant to Supplemental Rule C(1) for Admiralty and Maritime Claims under the Federal Rules of Civil Procedure and Local Admiralty Rule C(2)(a), the Clerk of Court is directed to issue a Warrant for Arrest and/or Summons In Rem against the Defendant Vessel identified in the Motion. The United States Marshal for the Southern District of Florida is hereby authorized and directed (upon seizure of M/Y ESPADA, a 1991 132' Heesen Motor Yacht, its engines, equipment, tackle, rigging, furnishings, and other appurtenances, etc. (hereinafter, the "Defendant Vessel") pursuant to the Warrant of Arrest), upon payment of all Marshal's costs by Plaintiff, to surrender the possession thereof to the Substitute Custodian named herein.
