TEXT ORDER: Plaintiff asserts diversity as the basis for jurisdiction. The complaint, however, only contains a conclusory allegation that "[u]pon information and belief, the claims in The Underlying Litigation involve an amount in controversy in excess of the jurisdictional limit of $75,000.00." See 28 U.S.C. §1332(a); Auto-Owners Ins. Co. v. Stevens & Ricci Inc., 835 F.3d 388, 395 (3d Cir. 2016) (stating that the "party invoking diversity jurisdiction... bears the burden to prove, by a preponderance of the evidence, that the amount in controversy exceeds $75,000.").Plaintiff shall file a declaration by January 3, 2025 demonstrating that this case satisfies the amount in controversy in 28 U.S.C. §1332(a).
