TEXT ORDER that the Court has reviewed the Complaint1 and the Motion2 seeking preliminary relief. The Motion includes a request for leave to proceed via Order to Show Cause. The Court hereby DENIES that request on the basis that Plaintiff has failed to make the "clear and specific showing... of good and sufficient reasons why a procedure other than by notice of motion is necessary" under Local Civil Rule 65.1. The Motion will therefore be treated as a motion for preliminary injunction. Accordingly, the Clerk's Office is instructed to issue summons. Plaintiff shall serve the summons, the Complaint1 , the Motion2 , and a copy of this Order on Defendants in accordance with the federal and local civil rules. As soon as practicable, The parties are to meet and confer and submit a joint letter when they are prepared to conference with the Court. In the meantime, the deadline to respond to the Motion2 is hereby STAYED. So Ordered by Judge Zahid N. Quraishi on 12/20/2024. (kas) |
