ENDORSED ORDER striking 6 Motion to set aside foreclosure sale. Movant may reassert such a motion within 10 days but must address the following that appears from a cursory review of the docket: The removal was not filed in this Court until 5:32 pm on January 22, 2025 when the instant case was first opened. Until that time there was no federal case pending to remove anything to. A "notice of removal" without a federal case number and bearing a federal caption was filed in State Court on 1/17/25 but there was no federal case (apparently) pending. The sale occurred on 1/21/25 but there was no federal case opened until a day later, and the County Clerk's certificate memorializing the sale was filed in state court on 1/22/25 about five hours before the federal case was opened. How could a federal case opened on 1/22/25 stop a sale that occurred on 1/21/25? Further, what is the federal jurisdiction that is stated in the notice of removal and what evidence is there of same in the documents attached thereto? Signed by Judge William F. Jung on 1/27/2025. NOTICE of Local Rule 1.07(c), Local Rule 3.02(a)(2), and Local Rule 3.03. -Local Rule 1.07(c) requires lead counsel to file promptly a Notice of a Related Action identifying and describing any related action either pending or closed in the Middle District or elsewhere. -Local Rule 3.02(a)(2) requires the parties in every civil proceeding, except those described in subsection (d), to file a case management report (CMR) using the uniform form at www.flmd.uscourts.gov. The CMR must be filed (1) within forty days after any defendant appears in an action originating in this court, (2) within forty days after the docketing of an action removed or transferred to this court, or (3) within seventy days after service on the United States attorney in an action against the United States, its agencies or employees. Judges may have a special CMR form for certain types of cases.
