ENDORSED ORDER granting motion to dismiss and dismissing fourth amended complaint 4 . The fourth amended complaint is dismissed as not cognizable and violative of the Federal pleading rules. If Plaintiff wishes to assert a fifth amended complaint, it must be on file within 21 days. If it is not on file within 21 days (not just mailed in, but on file) this case will be closed permanently. The Plaintiff must not assert dozens of claims stretching 250+ pages. Plaintiff must go to the Middle District of Florida website and consult very carefully the entries for "litigants without lawyers." Plaintiff must use the "Pro Se 1" form provided on the website as the template for any fifth amended complaint. Plaintiff may not assert a fifth amended complaint longer than 50 pages or in excess of eight defendants. It is important to follow the instructions given on the website and to use the forms there - they are placed there for the benefit of Plaintiffs without counsel. If Plaintiff is suing any Florida counties, only those counties within the Tampa Division of the Middle District may be included in the law suit. If Plaintiff wishes to sue other counties, Plaintiff must file a law suit against the other counties in the Division of the Middle District in which the counties are sited. These counties are listed on the website. Any amended complaint must be short, and it must be plain: No more than eight defendants, no more than 50 pages. Plaintiff should consider that any defendant that is sued must be served with process, and that is a cumbersome effort entailing some expense for Plaintiff to bear. Signed by Judge William F. 2 | 2 ORDER: Defendant Grant Street Group, Inc.'s motion to dismiss or, alternatively, to transfer venue 143 is granted subject to the requirements of this order. Consistent with the forum-selection clause from the governing contract, this Court finds that Plaintiff's claims against Defendant Grant Street Group, Inc. will be transferred to the United States District Court for the Middle District of Florida under 28 U.S.C. § 1404. The transfer shall be stayed pending resolution of whether the entire case will be transferred or only the claims against Defendant Grant Street Group. Furthermore, by 10/7/2024, Plaintiff and Defendant Bank of America, N.A. each shall file a short submission (no more than 5 pages) setting forth their respective positions as to whether the claims against Defendant Bank of America, N.A. should be severed from the claims against Defendant Grant Street Group, Inc. such that they remain before this Court or whether those claims should be transferred to the United States District Court for the Middle District of Florida too. Plaintiff's motion to strike Defendant Grant Street Group, Inc.'s motion to dismiss 230 is denied, and Defendant Grant Street Group, Inc.'s motion to strike Plaintiff's filings opposing the motion to dismiss 232 is denied as moot. Wood: Consistent with the Court's written ruling 270 and as stated on the record at the 11/21/2024 status hearing 277, the claims against Defendant Bank of America, N.A. are severed from the claims against Defendant Grant Street Group, Inc. and all other Defendants (i.e., the various Florida Counties and Florida Circuit Courts) identified in the Fourth Amended Complaint. The Clerk's Office is directed to open a new civil action directly assigned to Judge Wood and Magistrate Judge Jantz and to docket under the new case number (1) this Order as Docket Entry Number 1, (2) the Court's Order entered on 9/30/2024 270 as Docket Entry Number 2, (3) Plaintiff's Fourth Amended Complaint 89 as Docket Entry Number 3, and (4) Defendant Grant Street Group's motion to dismiss 143 as Docket Entry Number 4. In addition, the pro se appearance for Plaintiff Doris Walker 215 and attorney appearances for Defendant Grant Street Group, Inc. 120, 121, 126, 127, in Case No. 21cv3589 shall be entered in the docket of the newlyopened case. To clarify this Court's intent, all Plaintiff's claims against Defendant Bank of America, N.A. will proceed under Case No. 21cv03589 in the Northern District of Illinois. Plaintiff's claims against Defendant Grant Street Group, Inc. and the putative claims against the various Florida Counties and Circuit Courts identified in the caption to the Fourth Amended Complaint will proceed under the new case number, which will be transferred to the United States District Court for the Middle District of Florida. Once the new case is opened, it shall be transferred to the United States District Court for the Middle District of Florida forthwith. The transferee court shall make any necessary determinations regarding Plaintiff's satisfaction of the filing fee or ability to proceed in forma pauperis in the new action.
