MINUTE ORDER: Plaintiff's6 Disclosure Statement Pursuant to Fed. R. Civ. P. 7.1 indicates Plaintiff "is a natural person residing at 715, Parkside Drive NE, Albuquerque, Bernalillo County, New Mexico 87123." (emphasis added). However, residency is not synonymous with domicile, see Miss. Band of Choctaw Indians v. Holyfield , 490 U.S. 30, 48 (1989), and "[f]or purposes of diversity jurisdiction, a person is a citizen of a state if the person is domiciled in that state." On or before February 9, 2025, Plaintiff shall file a new disclosure statement confirming her place of domicile. The statement need not include information about Defendant's domicile, as Defendant will be required to file a disclosure statement if and when he enters the case. MINUTE ORDER: Plaintiff asserts federal jurisdiction pursuant to 28 U.S.C. § 1332(a). See ECF1 . Under Rule 7.1 of the Federal Rules of Civil Procedure, "[i]n an action in which jurisdiction is based on diversity under 28 U.S.C. § 1332(a), a party... must, unless the court orders otherwise, file a disclosure statement. The statement must name and identify the citizenship of every individual or entity whose citizenship is attributed to that party." Fed. R. Civ. P. 7.1(a)(2). This disclosure statement is to be filed "when the action is filed in... federal court," Fed. R. Civ. P. 7.1(a)(2)(A), or at the time of the party's "first appearance, pleading, petition, motion, response, or other request addressed to the court." Fed. R. Civ. P. 7.1(b)(1). Accordingly, it is ORDERED that, on or before February 6, 2025, Plaintiff shall file a Rule 7.1 disclosure statement, and within seven days of Defendant's appearance in this matter, Defendant shall file a Rule 7.1 disclosure statement.
