NOTICE AND ORDER: The1 Notice of Removal, filed by Defendant Sammons Enterprises, Inc. ("SMI"), alleges that this Court has diversity jurisdiction pursuant to 28 U.S.C. 1332. However, the Notice of Removal alleges that both Plaintiffs, Keisha Buckley and Cindy Lee, and Defendant James Carter, are Louisiana citizens. R. Doc. 1, paragraphs 9-10, and 18. Therefore, complete diversity does not exist. While SMI alleges that Carter has not yet been served, that does not have bearing on the jurisdictional issue of whether there is complete diversity of citizenship between the parties. "A non-resident defendant cannot remove an action if the citizenship of any co-defendant, joined by the plaintiff in good faith, destroys complete diversity, regardless of service or non-service upon the co-defendant. Whenever federal jurisdiction in a removal case depends upon complete diversity, the existence of diversity is determined from the fact of citizenship of the parties named and not from the fact of service." In re Levy, 52 F.4th 244, 246 (5th Cir. 2022) (which thoroughly explains that a SNAP removal, which appears to be what SMI is relying on in this case, is permissible only when all the named parties are completely diverse). IT IS ORDERED that a telephone conference is set for February 10, 2025 at 10:00 a.m. to discuss jurisdiction. Before the conference, counsel for SMI is ORDERED to review In re Levy. If after reviewing In re Levy SMI agrees that the Court does not have diversity jurisdiction, SMI shall move to withdraw the Notice of Removal on or before February 7, 2025, in lieu of appearing for the conference. Counsel participating in the Conference shall call 225-372-6199 using phone conference ID 194727947 five minutes prior to conference. Signed by Magistrate Judge Erin Wilder-Doomes on 2/3/2025.
