ORDER Directing Plaintiffs to File a Fed. R. Civ. P. 7.1 Disclosure. Fed. R. Civ. P. 7.1(a)(2) now requires all parties in diversity cases to file a disclosure statement naming and identifying the citizenship of every individual or entity whose citizenship is attributed to that party or intervenor as of "when the action is filed in or removed to federal court...." Defendants previously filed Rule 7.1 disclosures. See ECF Nos. 6 and 7. The Court directs Plaintiffs to file their Rule 7.1 disclosures on or before February 14, 2025. The Court reminds Plaintiffs that for the purposes of diversity jurisdiction, the citizenship of the administrator of an estate is deemed to be that of the decedent, not the administrator's personal citizenship. See 28 U.S.C. § 1332(c)(2) ("[T]the legal representative of the estate of a decedent shall be deemed to be a citizen only of the same State as the decedent."). Additionally, an individual's citizenship is determined by her domicile. Siloam Springs Hotel, LLC v. Century Sur. Co. , 781 F.3d 1233, 1238 (10th Cir. 2015). Signed by Magistrate Judge Rachel E. Schwartz on 2/7/2025. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.)(bh) |
