Counsel advised the Court's staff that Plaintiff's counsel filed a notice of motion on November 14, 2024 (Dckt. No.9 ). The Court previously entered an order on November 15, 2024, advising Plaintiff's counsel that noticing a motion is not the proper way to proceed. Plaintiff's counsel explained to the Court's staff that the motion was merely intended to remind the Court of the pendency of the original motion (Dckt. No.1 ) that initiated this subpoena enforcement action. The Court has since reviewed Plaintiff's motion to compel compliance with a subpoena (Dckt. No.1 ). It appears that service of this motion on the recipient of the subpoena, Adeena Weiss-Ortiz and Weiss Ortiz P.C., was effectuated approximately two weeks ago, on November 4, 2024. See Dckt. Nos.7 ,8 . Given the time that has passed since service, the Court sets a deadline of December 3, 2024 for the two subpoenaed witnesses to respond. Plaintiff's reply will be due on December 10, 2024. The Court directs the movant to serve a copy of this order on Adeena Weiss-Ortiz and Weiss Ortiz P.C. by U.S. Mail and by email, and file a certificate of service.
