TEXT ORDER entered by Judge Colin Stirling Bruce on 3/13/2025. Plaintiff's motion for leave to file an amended complaint3 is DENIED. On March 4, 2025, the Court dismissed this case based upon Plaintiff's failure either to pay the required filing fee in full or to move for leave to proceed in forma pauperis. In previous Orders, the Court warned Plaintiff that the Court would dismiss this case if he failed to take one of these two actions. Nevertheless, Plaintiff did not respond to the Courts' Orders; Plaintiff did not pay the required filing fee; and Plaintiff did not move for IFP status. Accordingly, the Court dismissed this case, and the filing of an amended complaint in a closed case is not proper. Therefore, Plaintiff's motion is denied. To the extent that Plaintiff was attempting to file a new case based upon the Complaint that he submitted, Plaintiff will need to re-submit that Complaint along with a payment for the required filing fee (in full) or with a motion for leave to proceed in forma pauperis in order to proceed in a new civil rights lawsuit. TEXT ORDER Entered by Judge Colin Stirling Bruce on 3/4/25. On February 6, 2025, Plaintiff filed this case under 42 USC Section 1983 alleging a violation of his Constitutional rights. However, Plaintiff did not pay the required filing fee, nor did he move for leave to proceed in forma pauperis in this case. Accordingly, that same day, the Court ordered Plaintiff either to pay the filing fee or move for IFP status in order to proceed in this case. The Court gave Plaintiff until February 27, 2025, to take one of these actions. The Court warned Plaintiff in this February 6, 2025 Order that the Court would dismiss this case if he did not take the required action. As of today, Plaintiff has not paid the required filing fee, nor has he moved for leave to proceed in forma pauperis in this case. Accordingly, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to comply with the Court's Orders and based upon Plaintiff's failure either to pay the required filing fee or to obtain IFP status. This case is closed. No judgment to enter. (ANW)
