ORDER granting in part and denying in part7 . First, the Court is not going to extend the time of the non-appearing defendants to appear because if the City isn't going to protect their interests, the Court certainly isn't going to. Second, defendants' counsel is not subject to an "accelerated" discovery schedule in the Ramirez case. He is subject to the original schedule which Judge Subramanian imposed -- indeed, Judge Subramanian already extended it once based on the same "change of counsel" excuse that the ACC is raising here. It has only become "accelerated" because the parties didn't meet the schedule that Judge Subramanian set. Third, the City and DOE can have until 6/27/2025 to answer because "[i]n truth, the answer in a civil action is the most useless paper in the courthouse." Alexander By and Through Alexander v. Richardson-Merrell Inc. , 541 F.Supp. 93, 94 (S.D.N.Y. 1982). Finally, because the answer is of little or no value, the Court does not wait for an answer to commence discovery. The Initial Status Conference is adjourned only to 6/5/2025 at 11:30 am. The parties are directed to call 571-353-2301 and enter Meeting ID 949146687# and are reminded of their obligations to comply with the mandatory requirements at 5 with regard to the conference.
