12 12 order 2 - Minute Order ~Util - Set/Reset Deadlines/Hearings Mon 04/14 12:09 PM
MINUTE ORDER (text only) authorized by Judge Lauren King. The Court, having reviewed Plaintiff Protego Holding Corporation's9 Response to Order to Show Cause and10 Amended Complaint in response to its earlier7 Order to Show Cause, finds that Protego has still failed to adequately allege citizenship of all parties. Specifically, Protego offers only conclusory allegations regarding the citizenship of the individual Defendants as well as the sole member of Sherri R. Scheffer, CPA, PLLC without alleging their domicile. Dkt. No.10 at 4-5. "Without allegations as to [these Defendants]' domicile, their citizenship cannot be determined." Martinez v. Univ. of San Diego, No. 20CV1946-LAB-WVG, 2020 WL 10965119, at *1 (S.D. Cal. Nov. 3, 2020); see also Fifty Assocs. v. Prudential Ins. Co. of Am., 446 F.2d 1187, 1190 (9th Cir. 1970) ("Failure to make proper and complete allegations of diversity jurisdiction relegates a litigant to... jurisdictional purgatory[.]"); McDonough v. Bidwill, No. CV 24-00764 PHX-DWL, 2024 WL 2795296, at *4 (D. Ariz. May 31, 2024) (finding allegation that a party is a citizen of a state insufficient because it "does not explain why or provide any factual avowals in support of those conclusions"). The Court therefore declines to discharge its7 Order to Show Cause, and grants Protego leave to amend its complaint to address these deficiencies within 10 days of the date of this Order. If Protego fails to correct these deficiencies, the Court will dismiss this case. (APH)
