ORDER. Defendant Velia Valdez filed two motions in this closed criminal case requesting that the Court order her federal sentence to run concurrent with her state sentence and requesting that her federal sentence be credited with any time spent in state prison. Dkt. Nos. 123, 129. As explained herein, the Court lacks jurisdiction to entertain Valdez's requests. The Clerk is directed to (1) terminate Valdez's motions in her closed criminal case on the basis of this order, (2) open for statistical purposes a new habeas corpus action under 28 U.S.C. § 2241 (nature of suit code 530, with the respondent listed as the Warden, FCI Hazelton), (3) file Dkt. No. 123 as the originating document in the new case and Dkt. No. 129 as a supplemental document, (4) docket a copy of this order in the new habeas action, and 5) close the new civil action on the basis of this order.
