TEXT ORDER: In paragraph four of Defendant's 9 Reply to Court's Standing Order on Removed Cases, one of her bases for thinking "the amount in controversy exceeds $75,000.00" is Plaintiff's refusal to "admit that the amount in controversy did not exceed $75,000 and that Plaintiff would at no time seek to recover an amount in excess of $75,000." But, this Court has previously held "[a] plaintiff's refusal to stipulate to maximum damages does not establish the claim exceeds $75,000. At best, it provides a tenuous and hypothetical inference." Legg v. Peterbilt of Atlanta, LLC, No. 0:23-cv-4534-MGL, 2024 WL 1679399, at *3 (D.S.C. April 18, 2024) (citation and internal quotation marks omitted). Therefore, not later than April 17, 2025, Defendant shall file a reply to this Order showing cause why this case should not be remanded to state court for failure to satisfy the jurisdictional amount requirement.
