Within 21 days of the entry of this order, Plaintiff must pay the $405 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914. TEXT ORDER entered by Judge Colleen R. Lawless on 4/21/2025. Plaintiff has filed a Complaint1 and a Motion for Counsel, which are both unsigned. Under Federal Rule of Civil Procedure 11, "[e]very pleading, written motion, and other paper must be signed by a party personally if the party is unrepresented." Fed. R. Civ. P 11(a). "The court must strike an unsigned paper unless the omission is promptly corrected after being called to the attorney's or party's attention." (Id.) Plaintiff has until May 12, 2025, to refile a signed Complaint and Motion for Counsel. Failure to comply will result in dismissal of this case without prejudice. (KE) |
