![]() SCREENING ORDER - it is HEREBY ORDERED THAT: (1) Plaintiff shall, if he chooses, file an amended complaint on or before 5/28/2025. Failure to file an amended complaint may result in the dismissal of this case. Again, Plaintiff is placed on notice that any amended complaint must be complete in all respects; it must be a new pleading that complies with the requirements of the Federal Rules of Civil Procedure which stands by itself without reference to the complaint already filed. The amended complaint will completely replace the original complaint, therefore if Plaintiff chooses to file an amended complaint, the original complaint will have no role in the future of this case. ![]() ORDER - it is hereby ORDERED that: (1) Plaintiff's application for leave to proceed in forma pauperis3 is GRANTED. (2) Plaintiff shall pay the full filing fee of $350.00, based on the financial information provided in the application to proceed in forma pauperis. The full filing fee shall be paid regardless of the outcome of the litigation. (3) Pursuant to 28 U.S.C. § 1915(b)(l) and (2), the Warden, or other appropriate official at Plaintiff's place of confinement is directed to deduct an initial partial filing fee of 20% of the greater of: the average monthly deposits in the inmate's prison account for the past six months, or the average monthly balance in the inmate's prison account for the past six months. (4) The Clerk of Court is DIRECTED to send a copy of this Order to the Warden of the institution wherein Plaintiff is presently confined. (5) Plaintiff's Complaint is DEEMED filed. (6) Plaintiff is reminded that he has an affirmative obligation to keep the Court informed of his current address. If Plaintiff's address changes while this lawsuit is pending, Plaintiff must immediately inform the Court in writing. If the Court is unable to communicate with Plaintiff because he has failed to notify the Court of his address, Plaintiff may be deemed to have abandoned the lawsuit. (7) Pursuant to 28 U.S.C. § 1915(e)(2), the Court will conduct a preliminary review of Plaintiff's complaint. Service of process will be held in abeyance until the screening process is complete.
