TEXT ORDER denying7 Plaintiffs' request for an Order to Show Cause but reserving decision on7 their underlying motion for a preliminary injunction pending the completion of briefing and the holding of a hearing under Fed. R. Civ. P. 65. Plaintiffs' request for an Order to Show Cause is unsupported by a showing of good and sufficient cause why the standard motion procedure (i.e., advanced notice, 21 days for an opposition, and 7 days for a reply) cannot be used with regard to their motion for a preliminary injunction. Plaintiffs argue that Local Rule 7.1(a)(2)'s meet-and-confer requirement would so delay the onset of the standard motion procedure as to prevent a decision by June 19, 2025. (Dkt. No.7 , Attach. 1, at 9.) See also N.D.N.Y. L.R. 7.1(a)(2) ("Prior to making any non-dispositive motion before the assigned Magistrate Judge, the parties must make good faith efforts among themselves to resolve or reduce all differences relating to the non-dispositive issue....") (emphasis removed). However, the Court rejects that argument for two alternative reasons. First, a motion for a preliminary injunction is properly considered as dispositive for purposes of Fed. R. Civ. P. 72. See, e.g., Brock v. City of New York, 21-CV-11094, 2022 WL 3445732, at *2 (S.D.N.Y. Aug. 17, 2022) ("Nor is such consent required for the Court to request a report and recommendation on a dispositive motion, such as the motion for a preliminary injunction and temporary restraining order."); Utica Mutual Ins. Co. v. INA Reins. Co., 12-CV-0194, 2012 WL 13028279, at *4 (N.D.N.Y. June 12, 2012) (Dancks, M.J.) ("Motions for a preliminary injunction have been labeled dispositive by district courts in the Second Circuit.") (citing two cases); Planck v. Schenectady County, 12-CV-0336, 2012 WL 1977972, at *2 & n.1 (N.D.N.Y. June 1, 2012) (Suddaby, J.) ("[I]n this District, when a party files a dispositive motion (such as a motion for a preliminary injunction), that party is not entitled to file a surreply."); Meaney v. Village of Johnson City, 10-CV-0070, 2010 WL 1633371, at *8 (N.D.N.Y. Apr. 21, 2010) (McAvoy, J.) ("The Court agrees that a motion for a preliminary injunction is dispositive and therefore, Plaintiff was not required to request a court conference before filing the instant cross-motion."); Mitchell v. Century 21 Rustic Realty, 233 F.Supp.2d 418, 430 (E.D.N.Y.2002) ("Motions for preliminary injunctions are dispositive matters."); Odom v. Senkowski, 96-CV-0554, 1997 WL 458450, at *1 (N.D.N.Y. Aug. 7, 1997) (Pooler,.J.) ("Because Odom's request for a preliminary injunction is a dispositive motion, the magistrate judge's recommendations require de novo review."); Rivera v. New York City Hous. Auth., 94-CV-4366, 1995 WL 546936, at *1 (S.D.N.Y. Sept. 14, 1995) ("This Court referred the action to the Honorable James C. Francis IV, United States Magistrate Judge, for supervision of discovery and preparation of a report and recommendation on certain dispositive motions, including plaintiffs' motions for preliminary injunctions."). Second, in any event, Plaintiffs' motion is being made not before U.S. Magistrate Judge Mitchell J. Katz but before the undersigned. (See Dkt. No.7 [attaching proposed Order to be signed by the undersigned].) Having said all of that, the Court will move the standard response deadline up a day (5/21/2025), and the standard reply deadline up a day (5/28/2025, so that a hearing may be held promptly on Thursday, May 29, 2025 at 9:30 AM in Syracuse, New York. Plaintiffs' counsel shall promptly serve a copy of this Text Order upon Defendants and ensure all other required service is in compliance with Rule 4 of the Federal Rules of Civil Procedure.
