![]() MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: ORDER DISMISSING COMPLAINT AND DENYING PENDING REQUESTS2 ,6 ,9 . With his case-initiating documents, Plaintiff filed an application to proceed without prepaying fees or costs, (IFP Appl., ECF No. 2), a request for service of process by the U.S. Marshal, , and a motion for a preliminary injunction enjoining judicial proceedings regarding the citation, (Mot. for Prelim. Inj., ECF No. 6). For the following reasons, the Court dismisses the complaint with leave to amend and denies all pending requests without prejudice to renewal. If Plaintiff seeks to file an amended complaint and requests, he must do so within 21 days. Failure to do so will result in dismissal without further warning. The request to proceed without prepayment of fees or costs must be denied because Plaintiff did not sign or date the request. Further, the complaint must be dismissed, under 28 U.S.C. § 1915(e)(2)(B), as the complaint fails to state a claim on which relief may be granted and seeks monetary relief against a defendant immune from suit.Because the Court cannot yet confer in forma pauperis status to Plaintiff, the Court denies the request for service of process by the U.S. Marshal. See 28 U.S.C. § 1915(d).The motion for a preliminary injunction must be denied for failure to comply with the procedural requirements for such motions. (lc) Modified on 5/12/2025 (lc) |
