ORAL ORDER: Plaintiff's Motion for Temporary Restraining Order (D.I.5 ) is DENIED. Plaintiff essentially seeks an emergency antisuit injunction: it asks for a temporary restraining order to enjoin Defendant from seeking to attach Plaintiff's Hunter Vessel in federal court. A party seeking a temporary restraining order must establish that (1) it is likely to succeed on the merits, (2) it will suffer irreparable harm in the absence of preliminary relief, (3) the balance of the equities tips in the movant's favor, and (4) a restraining order is in the public interest. Bullock v. Carney , 463 F. Supp. 3d 519, 523 (D. Del. 2020) (citing Winter v. Nat. Res. Def. Council Inc. , 555 U.S. 7, 20 (2008)). Having reviewed Plaintiff's submissions (D.I. 5, 6, 7, 8), the Court finds that Plaintiff has failed to establish a likelihood that it will suffer irreparable harm absent temporary relief. Assuming without deciding that Plaintiff has shown a pending risk that Defendant will soon file an action in federal court to attach Plaintiff's vessel, Plaintiff has not shown irreparable harm because it has the ability to litigate the validity of the attachment in that action.
